Having viable options when choosing an offshore jurisdiction is good for our industry and the investors we serve. The more informed investors and service providers are, the more likely it is that the appropriate jurisdiction will be selected for the particular type of investment contemplated. Bermuda has implemented legislative changes to make Bermuda’s fund product more attractive to market decision-makers. This seminar will (i) discuss our Investment Funds Act and imminent changes to our Investment Business Act, Partnership legislation and introduction of legislation addressing third party rights; (ii) explain Bermuda’s approach to AIFMD, CRS, FATCA and parallel UK IGAs (“UK FATCA”); and (iii) examine the role of the commercial courts in the asset management arena. Our panel, which will be moderated by Tonesan Amissah, Partner at Appleby, will include leaders from Bermuda law, audit and fund administration firms, along with a representative from the Bermuda Monetary Authority and the Bermuda Stock Exchange

Students will master the following at the conclusion of this session:

  • Recognize the current developments in Bermuda’s funds framework following discussions between Bermuda and ‘onshore’ industry professionals, Government and the Bermuda Monetary Authority
  • Identify the ongoing effects of the amendments to Bermuda’s Investment Funds Act 2006 and the anticipated effects of the Investment Business Amendment Act 2015
  • Appreciate licensing requirements/exemptions for Bermuda asset managers and opportunities for having a physical presence in Bermuda
  • Discover Bermuda’s position in relation to FATCA, parallel UK IGAs (“UK FATCA”), Common Reporting Standard and AIFMD
  • Differentiate between Bermuda’s fund classes
  • Apply the advantages of choosing Bermuda as a jurisdiction
  • Define Bermuda’s legislative approach to third party rights
